Development Applications
All proposed developments and land uses in the Redevelopment Area are subject to the need for Armadale Redevelopment Authority (the "Authority") development approval, under the Armadale Redevelopment Act 2001 (the "Act").
The sustainability audit is made under the Scheme provisions. It forms part of the development application and building application assessment and approval processes. It must therefore be carried out/completed/submitted under the head of power provided by the Act. It has been adopted under the relevant legislation and must be carried out in accordance with the legislative requirements.
The audit is a self assessment process. You will be required to nominate your level of compliance and forward a Sustainability Certificate with your application. The audit will specify if you are required to attach supporting information.
Exempt Developments
The audit must be completed for all new residential, multi-residential, commercial (office and other), industrial (office and other), civic, retail and recreational development. The audit does not need to be completed for renovations or extensions to existing buildings.
How do we know you will meet the requirements?
It is a statutory document and it is an offence under Regulation 7 of the Armadale Redevelopment Regulations 2003 to give misleading information. Penalties apply.
To lodge an application for development approval or building approval, you will be required to submit both a Sustainability Certificate and proof or evidence of your compliance. A checklist of submission requirements (a list of additional documents/proof of compliance that you must submit with your application) will be generated on completion of the audit process.
In addition to the City of Armadale site inspections, a final site visit will be undertaken by the City to ensure compliance with the various indicators identified in the audit.
Section 52 of the AR Act allows the ARA to issue a notice to a person who is contravening a condition of development approval to stop doing so or to cease, alter or remove any unlawful development.
